Ex- FBI Staff Member Asserts Unlawful Termination Over LGBTQ+ Symbol Display

An experienced FBI analyst has brought a legal case alleging his dismissed for exhibiting an LGBTQ+ banner in his office space.

According to David Maltinsky, who served with the bureau for 16 years, his dismissal recently was “illegal and discriminatory”.

Court Action Alleges First Amendment Violations

The lawsuit argues that the agency violated Maltinsky’s free speech protections and engaged in disciplinary measures against him because of expressing protected expression.

The former specialist is asking for a court order to reinstate his job with the FBI.

Details from the Lawsuit

The 18-page filing, lodged in the US district court for the District of Columbia, states that the plaintiff was terminated from his training recently over previously exhibiting the Pride symbol on his desk.

According to the document, the rainbow symbol was given to the employee in recognition of his work to advance the FBI’s inclusion programs.

Since childhood, my only desire was to serve the United States and protect the nation’s safety together with the talented and committed individuals of the FBI,” remarked Maltinsky.

He added, I showed that banner – that previously was raised before a federal building – not for political reasons, but as a representation of acceptance, solidarity and impartial service.

“These are the values that helped build a robust FBI. Now it is a place where individuals such as myself are targeted. I think I was fired not due to who I am, but due to my being: a homosexual man,” he affirmed.

Abrupt Dismissal Before Finish

Earlier this year, Maltinsky was accepted into the federal agent training academy at Quantico, Virginia, up until his “sudden termination just three weeks before completion”.

The complaint additionally states that at some point following the presidential inauguration, another employee expressed an alleged concern to his manager about the presence of the rainbow banner.

“Out of an abundance of caution, the employee asked that the legal advisor for the Los Angeles field office assess whether the exhibition of the symbol was allowed,” the filing noted.

It further mentioned, “The Chief Division Counsel advised Maltinsky that the display of the flag complied with any bureau guidelines.”

Informing of Termination

Despite this, on 1 October, the employee received notice of his dismissal.

In a document mentioned in the complaint, FBI director the official stated, I have concluded that you demonstrated bad decision-making by exhibiting of a partisan emblem in your work area during your previous assignment at the Los Angeles Field Office.

“Pursuant to Article II of the United States Constitution, and regulations of the nation, your position with the FBI is concluded.”

Attorney Comment

In a release issued this week, his legal representative his counsel said, The government’s unlawfully firing him forms part of an extensive initiative to purge federal agencies of staff that possess alternative perspectives, or are from minority populations, or who dare challenge bias.

His case goes beyond his situation, but about securing the liberties and protections of every government worker.”

The agency declined to comment about the legal action.

Maltinsky’s lawsuit is subsequent to a separate case submitted earlier by ex- senior FBI officials who alleged they were wrongfully terminated.

They stated that the official said he had been ordered by the president’s office to terminate any agent participating in a probe concerning Donald Trump.

Meanwhile, the bureau fired a long-serving employee earlier this month subsequent to the official allegedly grew upset due to accounts that the agency head flown on a government jet to go to a wrestling event at which his companion sang the national anthem.

The official, an FBI employee since 1998, was removed from his role in the bureau’s emergency unit, responsible for major security threats and the agency’s jet fleet.
